December Contest

RULES 

ARTICLE 1 – SCOPE

• These rules (hereinafter, the “Rules”) set out the general terms and conditions for the December Model contest (hereafter the “Contest”).

• These Rules govern the relationship between you, as a model/participant (hereinafter “You” or the “Model”) and, subject to the Model’s identified country/registered billing address, either JWS Americas S.à r.l., a Luxembourg law governed private limited liability company with registered address at 44, Avenue John F. Kennedy, L-1855, Luxembourg, Grand Duchy of Luxembourg, registered with the Luxembourg Trade and Companies Register under number 249.539 provided You are identified as based in the United States of America or JWS International S.à r.l., a Luxembourg law governed private limited liability company with registered address at 44, Avenue John F. Kennedy, L-1855, Luxembourg, Grand Duchy of Luxembourg, registered with the Luxembourg Trade and Companies Register under number 249.566 provided You are identified as based in any other country but the United States of America (JWS Americas S.à r.l. or JWS International S.à r.l. where relevant being hereafter referred to as “Website Operator”).

• The Contest is organized worldwide and is open to all Models active on livejasmin.com(hereafter the “Website”), unless forbidden by law.

ARTICLE 2 – CONTEST PERIOD

2.1 The Contest is in two phases and shall take place :

1^st phasis : between December 6^th, 2023 (at 00h00 CET) and December 19^th, 2023 (23h59 CET); and

2^nd phasis : between December 20^th, 2023 (at 00h00 CET) and January 2^nd, 2024 (23h59 CET) (hereafter collectively the “Period”).

2.2  The 1^st phasis consists of the main Contest period during which Models will challenge themselves to earn a bonus income.

The 2^nd phasis is the period during which Models will try to earn more, since the bonus that they potentially earned in the Contest (during the 1^st phasis) will be multiplied with their period earning.

2.3 Models must complete their participation in the welcome bonus by December, 6^th, 2023 (00h00 CET), the latest, to qualify for the Contest.

ARTICLE 3 – CONDITIONS FOR PARTICIPATION

3.1 The conditions to participate in the Contest are explained on the following page: https://livejasminwiki.com/December+contest (hereafter the “Wiki Page”).

3.2 Participation in the Contest is permitted to any person who has reached the age of 18 and is an active LiveJasmin Selected performer and active Amateur performers on the Website, excluding members of the Website Operator’s staff and collaborators, its affiliated companies and undertakings (including staff and collaborators) involved in the organization of the Contest, and excluding family members (immediate family or living at the same address) of persons belonging to the above excluded categories.

For the purpose of this article and Contest:

“active model” shall mean: Model whose profile has been approved by the Website Operator (other statuses are as follows: Pending, Closed, Suspended, Inactive, Missing Data).

“LiveJasmin Selected performer” shall mean: Models with the ‘Selected’ badge or status when they fulfil conditions foreseen by the Website Operator including having good video and audio quality, having completed their introduction, offer free content.  https://livejasminwiki.com/selection/

“amateur performers” shall mean: Models in the “amateur category” on the Website.

3.3 The Website Operator may at any time exclude anyone from participation in the Contest as a result of a breach of any of the conditions for participation, breach of the Rules or in the event of abuse, deception or malicious participation in the Contest.

3.4 By default, every Model of the Website participates in the Contest. However, any Model may indicate that they prefer not to take part in the Contest by contacting the Website Operator or, in case they win a prize, refuse it.

ARTICLE 4 – WINNERS SELECTION

4.1 The winners of the Contest will be those who, among the participants, have fulfilled the conditions (as explained in more details below) in full compliance with the Rules:

• • A Model will earn an additional 20% bonus income if the Model achieves the following cumulative conditions by the end of the first phasis of the Contest:
    • Model improves his/her own final conversion score by at least 70%; and
    • converts at least 300 new members on the Website.
  • A Model will earn an additional 40% bonus income if the Model achieves the following cumulative conditions by the end of the first phasis of the Contest:
  • Model improves his/her own final conversion score by at least 80%; and
  • converts at least 500 new members on the Website.

For the purpose of this article and Contest:

• “bonus income” shall mean: extra earnings granted to a Model based on their earnings paid via the Website from the following two-week period.
• “live on mobile” shall mean: time spent by the Model while being actively online via mobile on the Website.
• “new member” shall mean: a member who spent credits first time on the Model (via the Website) in his/her history.
• “to convert” shall mean: successful completion of a member’s paid transaction on the Model’s page on the Website.
• “conversation score” shall mean: a score based on the Model’s 7-day activities and consists of 14 goals, including tasks such as ‘Respond to messages within 15 minutes’, ‘Convert 50% of Hot Deals into Private Shows’, etc…” (those tasks are listed under Performance > Conversion Score page on https://modelcenter.livejasmin.com/). Each completed task increases performer’s Conversion Score. Conversion Score can increase/decrease during the Contest and only the final conversion score (i.e. the conversion score at the end of the first phasis of the Contest) will be relevant for this Contest. 4.2 The winners of the Contest will be selected based on whether they have achieved the conditions, as detailed hereabove, to earn a bonus income.

4.3 There can be as many winners as Models fulfilling the conditions to be awarded a prize in this Contest.

4.4 The winners will be personally contacted (via the Website and/or email) in order to get the information necessary for them to organize the collection of their bonus.

4.5 In the event of refusal of the prize or non-award thereof to the winner for other reasons, the prize will return to the Website Operator, who may, at its discretion, award it to a new winner or decide not to award it, without the previous winner being able to exercise any rights. 

4.6 Anyone required to confirm their data confirms that the data transmitted is correct, up-to-date and complete.

4.7 The Website Operator’s decisions concerning the determination of the winners are final and without appeal.

ARTICLE 5 – PRIZES

5.1 The prizes that can be awarded for this Contest are:

• • 20% bonus income; or
  • 40% bonus income

5.2 Bonuses will be awarded to the winner(s), after a double check that the conditions of the Contest have been complied with, and added to the Model’s earning (based on the amount they will earn during the following payout period). The Bonuses will be awarded during the next two-weeks payout after the Period (i.e. between January 3^rd, 2024 and January 16^th, 2024) and shall be added on each winner’s personal account via the Website.

5.3 A Model can only be awarded with either 20% bonus income or 40% bonus income. For the avoidance of doubt, those prizes/bonuses cannot be cumulated by a Model.

5.4 These prizes are personal, indivisible, non-transferable, non-exchangeable and must be accepted as awarded without any modification.

5.5 Throughout the duration of the Contest, each Model (same name, postal address, username and/or e-mail address) may only win one bonus.

ARTICLE 6 – CHANGES TO THE CONTEST

6.1 The Website Operator reserves the right to make changes to the Contest, to suspend, shorten, extend, postpone, or terminate the Contest at any time, without notice, without giving reasons and without compensation to the participants or third parties.

6.2 In the event that the Website Operator or one of its partners is forced to prematurely terminate, make changes to, extend or terminate the Contest as a result of the inappropriate behaviour of one of the participants, the Website Operator reserves the right to request compensation for the damage suffered accordingly.

ARTICLE 7 – RESPONSIBILITIES

7.1 Without prejudice to cases of gross or willful misconduct, neither the Website Operator, nor its staff, nor any third party involved in the Contest shall be liable for any direct or indirect damage of any kind that may occur during the Contest, or in connection with the participation in the Contest or as a result of the organization of the Contest, the designation of winners or the award (or non-award) of prizes, regardless of their source, cause or consequences, even when the Website Operator is informed of the risks of such damage.

7.2 Participation in the Contest implies knowledge and express acceptance of these Rules. The Website Operator shall not be held liable in any way for the organisation of the Contest. The prizes and the relevant rights for the winners are strictly subject to the conditions of application of these Rules. No recourse of any kind is therefore possible against the Website Operator.

7.3 The Website Operator shall not be liable in the Contest of loss or theft of the prize, or fraudulent conduct by a third party in connection with the Contest. More specifically, the Website Operator shall in no way be liable for any out-of-stock products, services or prizes in store, for the sending, for the delivery and receipt deadlines or for the loss of prizes, insofar as their distribution is tasked to a third company to the exclusion of any intervention by the Website Operator.

ARTICLE 8 – PERSONAL DATA

8.1 The Website Operator processes the personal data transmitted as part of the Contest in accordance with the applicable rules and the privacy policy (https://www.livejasmin.com/en/privacy-policy).

ARTICLE 9 – ACCEPTANCE AND APPLICATION OF THE RULES

9.1 Participation in the Contest implies unconditional acceptance of the Rules by the participants, including any subsequent amendments, and no challenge thereto will be taken into consideration.

9.2 Any complaint relating to the Contest shall be sent in writing within seven (7) working days following the end of the relevant quarter phase of the Contest to the Website Operator’s registered office. Under no circumstances may complaints be handled orally or by telephone. Complaints made after the deadline, not made in writing or for which the author cannot be identified by name will not be processed.

9.3 These Rules may be consulted at any time on the Wiki Page or upon request sent to the following email address: help@livejasmin.com.

9.4 The Contest is under the supervision of the Website Operator. In the event of force majeure, unforeseen circumstances or complaints, the Website Operator may take any necessary measure to ensure the smooth running of the Contest. Its decisions shall be final and cannot be challenged.

9.5 The participants undertake to fully comply with applicable law and to avoid any cheating in the context of this Contest or circumventing the Rules. In case of tampering, fraud or similar irregularities, the Website Operator is authorized to disqualify, suspend or ban a Model from the Contest and/or the Website or take any other measure that the Website Operator finds appropriate.

ARTICLE 10 – GOVERNING LAW AND JURISDICTION

10.1 The participants undertake, in the Contest of any discussion concerning the application or interpretation of the Rules, to seek first an amicable solution with the Website Operator before commencing any legal proceedings.

10.2 If any provision of the Rules is found to be null or void, the remaining provisions of the Rules shall remain in full force and effect. Any such invalid, ineffective or unenforceable provision shall, to the extent permitted by law, be deemed replaced by such valid, effective and enforceable provision as comes closest to the economic intent and purpose of such invalid, ineffective or unenforceable provision.

10.3 The Rules, as well as the conduct of the Contest itself, are subject to Luxembourg law. In the event of a dispute, the courts of Luxembourg shall have exclusive jurisdiction.
